Judge Finds in Favor of GHI

Judge Northrop awards no monetary damages in Greenbelt secondhand smoke trial.

Judge Albert Northrop ruled in favor of GHI in David S. Schuman v. Greenbelt Homes, Inc. et al.

Judge Northrop awarded Schuman no monetary damages in his case against his neighbors, the Popovics, and his housing cooperative, Greenbelt Homes, Inc. (GHI)—for its failure to prohibit the nuisance created by his townhome neighbors' secondhand smoke.

Northrop ruled that although secondhand smoke may be dangerous, in this case it is not a substantial nuisance. He also granted by consent a permanent injunction against inside smoking by the Popovics.

Northrop made no ruling to prevent Darko Popovic from smoking outside his townhome. After the trial, Schuman said because of the ruling he was going to have to move, if he's able to sell his house.
